Terms and conditions
TERMS AND CONDITIONS
1. AGREEMENT TO TERMS. By renting a trailer from M&M Trailer Rentals, LLC (“M&M Trailer Rentals”), the renter (“Renter”) agrees to all terms in this Rental Agreement. These terms apply to all trailer rentals occurring within the State of Washington.
2. RENTAL REQUIREMENTS. Renter must be at least 18 years old and possess a valid driver’s license. Renter must provide accurate identifying and payment information. M&M Trailer Rentals may refuse rental to anyone for safety, credit, or policy reasons.
3. TRAILER CONDITION, INSPECTION, AND MAINTENANCE. Trailers are provided in good working condition.
Renter must inspect the trailer and note any damage at pick-up and at return of the trailer. Renter shall maintain the trailer in good condition and is responsible for any damage beyond normal wear and tear. Unauthorized repairs or modifications are prohibited.
4. INSURANCE REQUIREMENTS. Renter must provide proof of comprehensive automobile liability insurance with minimum limits of $1,000,000 per occurrence and $250,000 for property damage, naming M&M Trailer Rentals as an additional insured. M&M Trailer Rentals does not provide insurance for the Renter, tow vehicle, cargo, or third‑party damages. Renter is responsible for verifying that their insurance covers trailer rentals.
5. PERMITTED USE AND GEOGRAPHIC RESTRICTIONS. Trailer must be used only for lawful purposes and in compliance with all applicable laws. Renter must ensure their tow vehicle is properly rated and equipped. Overloading, improper loading, or unsafe operation is prohibited. Trailer may not be taken outside Washington State without written permission from M&M Trailer Rentals. Subleasing or transferring possession to another party is not allowed.
6. RENTAL PERIOD, RETURN REQUIREMENTS, AND LATE FEES. The rental period begins when the trailer is released to the Renter and ends when it is returned and checked in. Trailer must be returned by the agreed date and time. Late returns incur the above-stated late fee. Failure to return the trailer by the scheduled return time may be treated as theft.
7. DAMAGE, LOSS, AND REPLACEMENT COSTS. Renter is responsible for full replacement cost if the trailer is lost or stolen. Renter is responsible for all repair costs in the event of damage, regardless of fault. Renter is responsible for any third‑party damage or injury arising from use of the trailer. M&M Trailer Rentals is not liable for delays, towing charges, or costs arising from breakdowns unless caused by M&M Trailer Rentals’ negligence.
8. CLEANING AND PROHIBITED MATERIALS. Trailers must be returned clean and free of debris; cleaning fees may apply. Transporting hazardous, flammable, or illegal materials is prohibited unless expressly permitted by law and M&M Trailer Rentals policy.
9. INDEMNIFICATION. Renter agrees to indemnify and hold harmless M&M Trailer Rentals from any claims, damages, losses, or expenses arising from the rental or use of the trailer.
10. TERMINATION AND REPOSSESSION. M&M Trailer Rentals may terminate this agreement and repossess the trailer upon any breach of terms. Renter is responsible for all costs associated with repossession resulting from a breach.
11. CANCELLATION AND REFUNDS. Cancellations made more than 24 hours before the rental start time may be eligible for a refund, subject to M&M Trailer Rentals policy. No‑shows or late cancellations may forfeit rental fees.
12. LIMITATION OF LIABILITY. To the fullest extent permitted by Washington law, M&M Trailer Rentals’ liability is limited to the amount paid for the rental. M&M Trailer Rentals is not responsible for consequential, incidental, or punitive damages.
13. GOVERNING LAW. This agreement is governed by the laws of the State of Washington. Any disputes shall be resolved in the courts of the county where the M&M Trailer Rentals is located.
14. ACKNOWLEDGMENT. By signing the rental agreement or taking possession of the trailer, Renter acknowledges they have read, understood, and agree to all Terms and Conditions.
